Terms And Conditions

Basics:

1. All sales are subject to the following terms and conditions.
2. All product prices are shown in euros, including statutory VAT (10%, 13%, or 20%) and excluding applicable shipping costs.
3. You must be at least 18 years old to make purchases from us.
4. Errors and changes reserved.
5. Misunderstandings, ambiguities, and mistakes should not happen, but they can – we will ALWAYS do our best to resolve any issues with you in the best possible way.
6. Please consider the legal situation in your country! All products may only be used within the scope of the laws applicable to you. By accepting these Terms and Conditions, you agree to hold us harmless from any violations on your part. We strictly disclaim any responsibility for misuse of our products!
7. The applicable laws in their current versions apply.

Orders, Withdrawal, and Prices:

1. You can place orders in our online shop through simple and clearly recognizable steps. You are also always welcome to visit our stores in Vienna, Brunn, and Vösendorf.
2. Your order in our online shop is binding. You have the right to return UNUSED goods within 14 days of receiving the shipment without giving any reason. The period begins upon receipt of the goods and this instruction.
   
   To comply with the deadline, it is sufficient to send the return request in writing (letter, email, or fax) or to dispatch the goods on time. Please ALWAYS contact us before returning any goods!

   In the event of a valid return, both parties must refund the goods and any derived benefits (e.g., usage advantages). Compensation may be required for deterioration of the goods, except where deterioration results solely from inspection, as would have been possible in a store.


   
   You can avoid the obligation to pay compensation by not using the goods as your own property and avoiding anything that diminishes their value. Once you exercise your right of return, the purchase contract becomes void.
   
   
3. All living products (e.g., seeds) are excluded from the right of withdrawal once their packaging or seal has been broken.
4. Your total price consists of the sum of the products ordered, applicable taxes, and packaging and shipping costs – collectively referred to as “shipping costs” or “shipping.” These are clearly shown in your shopping cart.
5. We expressly reserve the right to change prices. However, price changes will NEVER affect ongoing orders or payments – you always pay the price valid at the time of your order. We also reserve the right to reject orders without providing reasons. If this happens, we will of course inform you by email.
6. If customs duties or similar fees apply when shipping to your address, these are your responsibility.

Payment:

1. You can pay in advance, by bank transfer, or by credit card. In Austria and Germany, we also offer a cash-on-delivery service via GLS.
2. The goods remain our property until full payment has been received.

Shipping:

1. Your share of the shipping costs is clearly displayed during checkout.
2. We normally dispatch orders the next business day after payment is received. Depending on your location, delivery usually takes one to three working days. We typically ship with GLS Austria or DPD.
3. Your shipment will be packed in a neutral envelope or box, ensuring secure packaging. You never know what a parcel goes through before it arrives.
4. Upon delivery, the customer must inspect the package for transport damage. If the package is damaged, please do not accept it. We are not liable for damage caused by the transport company!

Website:

1. All prices are in euros, including statutory VAT and excluding shipping costs. Price changes and errors reserved. Logos, trademarks, and product names are the property or registered trademarks of their respective companies.

2. All product descriptions and photos originate – unless stated otherwise – directly from the producers, wholesalers, or from Bushplanet. Manufacturer texts are copied directly and not edited; therefore, we are not responsible for product descriptions provided by manufacturers. Product images may NOT be stored or used without written consent from Bushplanet.

3. In compliance with applicable laws and regulations, we expressly distance ourselves from the content of any external links on our website. We do not endorse or adopt their content in any way. The respective website operators are solely responsible for their content!

Coupon Codes:

1. Bushplanet coupon codes cannot be combined.
2. They may or may not apply to discounted products.
3. Only one coupon code can be used per order.

Special Terms for the Purchase and Shipping of Live Plants:

1. Scope

These terms apply to all orders placed by consumers or businesses on bushplanet.com that include live plants.

2. Right of Withdrawal / Return / Refund

Please note that according to § 312g para. 2 of the German Civil Code (BGB), the right of withdrawal does not apply to perishable or live goods. Therefore, returns or refunds for plants are not permitted.

3. Delivery and Shipping

Since these are live plants, shipments are only made on Monday, Tuesday, and Wednesday to avoid extended storage, especially over weekends.

All deliveries are shipped from our Austrian warehouse at the buyer’s risk and expense.

If the buyer refuses to accept the goods or fails to collect them from the designated pickup location despite notification, full payment of the invoice amount is still required.

4. Special Notes on Live Plants

These are natural products; slight variations in size, shape, and color are unavoidable and do not constitute defects. Plants may experience mild stress during shipping, which generally does not affect their growth. Successful cultivation depends on factors such as location, care, and external conditions, for which we cannot provide any guarantee.

5. Use of Plants

All buyers of plants agree to use them exclusively in accordance with the laws applicable in their country. All information on bushplanet.com regarding effects, yields, etc. is intended solely for customers in Germany who cultivate plants within the framework of the Cannabis Act (private cultivation or cultivation through associations).
